For the declaration of the reasons of public utility, three conditions must be cumulatively met, as follows:
- Carrying out of a preliminary investigation by a specialized commission;

- Registration of the work in the urban planning and land development plans, approved according to the law, for the city or area where the expropriation is to be carried out
